Ed Sheeran’s ‘Photograph’ has been compared with ‘Amazing’ written by song writers Martin Harrison and Leonard Thomas in 2009 which was sung by Matt Cardle in 2012.
Chord breakdowns have been analysed in court documents where is has been suggested there were many ‘identical’ similarities have been discovered.
The statement for the lawsuit assertively says:
“Given the striking similarity between the chorus of Amazing and Photograph, (the) defendants knew when writing, publishing, recording, releasing, and distributing Photograph that they were infringing on a pre-existing musical composition.
“The conduct of (the) defendants has been wilful from the inception of the creation of Photograph.
“The copying of Amazing by Photograph is breathtaking in its deliberateness, magnitude, and hubris.”
It has been suggested the plaintiffs are to use the same lawyer used in the recent case against Robin Thicke and Pharrell Williams for copyright infringement for their massive hit ‘Blurred Lines’. The winning settlement in this case was $7.4m. The Marvin Gaye estate now receive 50% of receipts from song writing and publishing revenues.
Harrison and Thomas say the notes can be easily compared by the untrained eye:
“The chorus sections of Amazing and the infringing Photograph share 39 identical notes – meaning the notes are identical in pitch, rhythmic duration, and placement in the measure,” the lawsuit reads.
“The songs’ similarities reach the very essence of the work,” it states. “The similarities go beyond substantial, which is itself sufficient to establish copyright infringement, and are in fact striking. The similarity of words, vocal style, vocal melody, melody, and rhythm are clear indicators, among other things, that Photograph copies Amazing.”
